From al.com–the owners of a pharmacy in Loxley, Alabama, near Mobile, were found not guilty yesterday following a jury trial in the U.S. District Court for the Southern District of Alabama. Tony Eric Mosley and James Goins, owners of Hemophilia Infusion Manager, were charged with other defendants for allegedly scheming to defraud Alabama Medicaid out of approximately $29 million. Mosley and Goins were alleged to have paid kickbacks to the owner of Hemophilia Management Specialties, a business in Theodore, Alabama, in exchange for lists of patients.
The two men had opened the pharmacy to help their sons, who both suffer from hemophilia, a rare blood-clotting disorder. The jury foreman told reporters that the jury quickly reached not guilty verdicts regarding Mosley and Goins, and that there was "hardly any" evidence against the two men. Mosley and Goins have had to close the pharmacy as a result of the criminal proceedings.
Jeff and Chris Vernon, two brothers and co-owners of MedfusionRx, a Birmingham area pharmacy, were convicted. Also convicted were Lori and Butch Brill, owners of Hemophilia Management Specialties. The convicted defendants are scheduled to be sentenced in June.
